What Documents Are Needed?

If you are ready to start the bankruptcy process, below is a list of required documents and the reasons we need them. Providing these items will help us move your bankruptcy forward quickly and efficiently.

California Identification Card or Driver's License

1. To Verify Your Identity

The court and the trustee must confirm that you are the person filing the case. Your driver’s license, along with your Social Security card, is used to verify your identity at the 341 Meeting of Creditors.

2. To Prevent Fraud

Bankruptcy involves sensitive financial information. Verifying identity helps prevent fraudulent filings or someone attempting to file a case under another person’s name.

3. To Match Your Information to the Petition

Your address on the petition should match your current residence. Your driver’s license helps confirm this, especially if any notices or court documents need to be mailed.

Copy of Your Social Security Card

Most Recent Debt Statements

We need an accurate and up-to-date picture of what you owe. These statements help confirm the balances, account numbers, creditor information, and the status of each debt. They also allow us to correctly list every debt in your bankruptcy paperwork, which is required by law. Providing recent statements ensures nothing is missed, protects you from creditors claiming you left them out, and helps us prepare the most accurate case possible.

Most Recent Vehicle Statement

Your most recent vehicle statement helps us confirm the exact loan balance, monthly payment, interest rate, and whether you’re current or behind. This information must be accurately listed in your bankruptcy paperwork. For Chapter 13 cases, it also helps us calculate any past-due amounts and determine whether your car can be saved, paid off through the plan, or restructured for a lower payment.

Most Recent Mortgage Statement

Your most recent mortgage statement is needed so we can confirm the exact balance, monthly payment, interest rate, and whether you are current or behind on payments. This information must be accurately listed in your bankruptcy paperwork and helps determine the best strategy for your case. Additionally, if you are filing Chapter 13, the statement also allows us to properly calculate any arrears and structure a repayment plan that protects your home and keeps you on track.

Last 2 Years of Tax Returns

The last two years of tax returns verify your income, confirm your financial history, and ensure your case meets all legal requirements. Tax returns help us accurately complete the means test, show the trustee a full picture of your finances, and confirm whether you owe or are owed any tax refunds. Trustees are required to review tax returns in every bankruptcy case, so providing them helps prevent delays and keeps your case moving smoothly.

Last 3 Months of Bank Statements

We need your last three months of bank statements to verify your income, track recent financial activity, and ensure all required information is accurately reported in your case. Bank statements help identify deposits, withdrawals, large purchases, transfers, and your current balances, all items the trustee reviews closely. These statements also help us confirm there are no transactions that could raise issues or delay your case, allowing everything to move forward smoothly and without surprises.

Last 3 Months of Paystubs

We need your paystubs from the last three months to verify your current income and accurately complete the bankruptcy forms. Paystubs show your earnings, deductions, insurance, retirement contributions, and any garnishments, all of which must be reported to the court. They also help us calculate the means test, determine your eligibility for Chapter 7 or Chapter 13, and ensure your case moves forward without delays or issues from the trustee.
